Mrs. Dungy for the first time appeared in the courtroom Thursday morning. She occupied a bench just within the railing where she talked a few minutes with her son Harvey before court convened. Later she walked over to the counsel table where Mrs. Worsham, mother of Lyle Worsham the slain man, sat with her son William. Mrs. Dungy shook hands with Mrs. Worsham and they talked a few moments with voices low and wavering about whether it would be better to stay and sit through the painfully slow procedure of selecting a jury or to return home and wait. “I Just wanted you to know, Mrs. Dungy told Mrs. Worsham, that I am so sorry for you.” “And we’re so sorry for you too, Ms. Worsham told her.” “Is this your son,” Mrs. Dungy asked Mrs. Worsham, pointing to William Worsham. “Yes, he’s younger than Lyle. Lyle was my oldest boy.” The women were silent for a moment then each said goodbye and Mrs. Dungy returned to her place on the bench. Dec 7, 1927

Dungy, Thomason and Booker took Worsham to Shady Rest and stayed there about forty minutes talking to Birger while Worsham remained in the car. “I heard Thomason talking to Worsham about “Squawking. They accused him of talking to Carl Shelton and Shag denied it. Thomason called him a liar. Dungy told Thomason that he wanted to kill Worsham and Fred said, Wo, I brought him out and I’m going to kill him.” (Lengthy article on page 1 & 3 of the MDR}  Dec 15, 1927

Harvey Dungy’s Day In Court  When Harvey Dungy took the witness stand during the trial here for the murder of Lyle Worsham on September 17, 1926. He testified that he was born September 16, 1897, in Franklin County and had worked as a miner, grocery salesman and oil salesman. He said that early September 1926 he took up residence at 909 West Main Street in Marion. He said the first time he was at Shady Rest was on October 15, 1926, in company with Lory Price and that he was there “a right smart in the latter part of 1926. On February 15, 1926, he became employed with the state highway department. He testified that Clarence Rone threatened to kill him for reporting on the Price murders and said he would blow up his building near West Frankfort and the building was blown up in April 1927. During July 1927 Dungy said Rone spoke to him in the county jail here and told him, “You messed me up in the Price case and I’m going to hang you if I have to frame you.” Dungy denied he had confessed to the Worsham murder. He told of living in Marion during September 1926 and that from September 16 to 18 he was at the home of his father-in-law, John Carmean in Hamilton County. Dungy denied that he had any association with Charlie Birger and denied he had ever gone anywhere with Birger except one time. Objections by the prosecution prevented him from telling where he went with Birger that one time he spoke of. Contradicting the testimony of Wayne Sprague, Dungy denied ever knowing Lyle Worsham, the murdered man and also denied going to Zeigler with Fred Thomason or Joe Booher anytime and said he had anything whatever to do with the killing of Worsham or the burning of his body. Dungy said he met Booher in Benton November 1926 at Booher’s place where Dungy said that he stopped with his little girl to get a bushel of apples. He said Eural Gowan, the eyewitness of the alleged Worsham killing, was prejudiced against him. “Gowan cussed me out for not testifying for him.” He said Wayne Sprague was also sore at him because he had thrown Sprague out of a place he owned near West Frankfort because Sprague had been selling booze. States Attorney Arlie 0. Boswell revealed Monday morning that he had been approached on two different occasions by men purporting to represent Harvey Dungy, Joe Booher and Fred Thomason before their trial and offered their plea of guilty in exchange for his consent to a life sentence for each of them.

“Understand that I was not approached by the defendants themselves,” Boswell said. have never talked with any of the defendants about anything except here in the courtroom when one of them spoke to me.” States Attorney Boswell said that he was so impressed with the horror of the crime and so confident of the guilt of the three men that he felt the public would not endorse any compromise on the part of the state’s attorney and he elected to go to trial. Several members of the Worsham case jury told the newspapermen that they could not overcome the doubt that was raised by inconsistencies in the evidence. “There were too many loopholes,” one gray haired man said. “We could not convict anybody of so serious a crime when there were so many places for doubt about their guilt to creep in.” Bert Scobey, local undertaker, had testified that the body taken from the burned Meneese building was that of a woman and his testimony carried some weight with the jury. One of the jurors after the verdict had been returned said, “We couldn’t convict the men on trial when we didn’t know whether the one killed was a man or a woman.” Dec 19, 1927
